In relation to the lawsuit filed by the Socialist Sewer Spokesperson, Gabriel Esturillo Cánovas, Joaquín Buendía Gómez, Alcantarilla Mayor, the Popular Party wants to make the following facts known to the media:
That the complaint filed by the socialist spokesperson, Esturillo, is only intended to defame and undermine the public image of Mayor Joaquín Buendía.
The only purpose is to judicialize the policy, request resignations or impel censorship motions in order to remove who won the 2015 municipal elections.
The complaint is implausible.
The documentation provided by the socialist Esturillo is only partial and interested and leaves evidence of the malicious performance of the same.
It must be taken into account that the members of the corporations have legitimacy before the contentious jurisdiction to urge the review of the municipal action and request the nullity or suspension of resolutions or actions.
In this sense, article 22 of Law 7/1985, of April 2, Regulating the Bases of Local Regime, provides that the Plenary is competent to control and supervise the governing bodies.
But instead of using the means that are legally available, the socialist, Gabriel Esturillo Cánovas, has chosen to use the criminal way inadmissible, spending useless forces on all involved in the process and condemning the Mayor in advance to trial public, which is really their sole objective.
Gabriel Esturillo accuses the Mayor of maintaining a contract for basic services for the maintenance of schools since 2004 without doing anything to regularize their contractual situation.
Well, remembering before the current mayor, D. Joaquín Buendía Gómez takes office on June 13, 2015, below we detail the actions that Mayor Joaquín Buendía has carried out in what takes the mandate regarding the contract object of the complaint:
May 2016: Agreement of the Governing Board of the beginning of the contracting file of the service of ordinances in schools.
September 2016: Agreement of the plenary session of municipalization of the concierge service.
With the votes in favor, among others, of Gabriel Esturillo.
Faced with this full agreement, the bidding for the contract proposed by the Government Board is paralyzed and the process of municipalization of the services begins.
December 2016: Resolution of the Mayor's Office of the municipalization of the contract object of the complaint and order the issuance of legal, economic and technical reports.
December 2016: Issuance of legal report.
January 2017: Issuance of report of the Contracting Section.
February 2017: Issuance of a report from the Service Manager of the Works, Public Roads and Maintenance Area.
February 2017: Issuance of report of the Economic Consultant, Legal Counsel and Intervener.
March 2017: Remission of the reports to the Ministry of Finance.
March 2017: Response from the Ministry of Finance informing that it would entail a modification in the adjustment plan and the following reports should be requested:
July 2017: Response from the General Secretariat of Territorial Coordination.
Being the report contrary to the municipalization of services.

August 2017: Answer of the General Direction of Public Function.
Being the report contrary to the municipalization of services.
September 2017: based on previous reports, the report of the municipal legal services on the municipalization of the service of ordinances in schools is issued.
Being the report contrary to the municipalization of services.
Faced with such facts, the Government Team approves:
October 3, 2017: Agreement of the Governing Board declaring that there is no place for municipalization and agreeing to the resumption of the suspended files.
Ordinary meeting of October 2017: The full agreement of the Governing Board is reported, declaring that there is no place for municipalization and agreeing to the resumption of the suspended files (Doc. 30).
October 2017: Approval of the contract file, the specifications and start of the procedure for its bidding (Doc. 31).
In the middle of this process, on July 30, 2017, Gabriel Esturillo filed the criminal complaint against Joaquín Buendía for the irregular status of this contract, when it is he, who along with other members of the corporation, voted in favor of a municipalization of the service and paralyze the bidding of the same.
Municipalization that is finally impossible to carry out.
It is unquestionable, that this quarrel only seeks political redito diminishing the public image of Joaquín Buendía, Mayor of Alcantarilla.
